Acceptance of Terms

By accessing or using Devscale's services, you agree to be bound by these Terms of Service. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the services.

Account Terms

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You may not use the services to transmit malicious code, interfere with platform operations, attempt unauthorized access, engage in cryptocurrency mining without authorization, or violate any applicable laws or regulations.

Payment & Billing

Fees for services are as specified on our pricing page or in your order form. All payments are non-refundable unless otherwise stated. We reserve the right to suspend services for non-payment. Prices are subject to change with 30 days' notice. You are responsible for all taxes associated with your use of the services.

Intellectual Property

Devscale retains all rights to its platform, technology, and branding. Your data and content remain your property. You grant us a limited license to process your data as necessary to provide services. You may not copy, modify, or distribute any part of our platform without written consent.

Limitation of Liability

To the maximum extent permitted by law, Devscale shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim. The services are provided "as is" without warranties of any kind.

Termination

Either party may terminate this agreement with 30 days' written notice. We may suspend or terminate your access immediately for breach of these Terms. Upon termination, your right to use the services ceases. We will make your data available for export for 30 days following termination.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, CA, under the rules of the American Arbitration Association. Either party may seek injunctive relief in court.
